Frequently Asked Questions about Personal Injury Cases in Alabama

How long do I have to file a personal injury claim in Alabama?

In most personal injury cases, Alabama’s statute of limitations gives injured individuals two years from the date of the injury to file a lawsuit. Notice of certain claims involving government entities must be provided within a shorter deadline; the two-year period may also be extended if the injured person is a minor. Missing the deadline typically bars recovery entirely, which is why it is important to consult with an attorney as soon as possible after an injury.

What compensation can I recover in a personal injury case?

Depending on the circumstances of your case, compensation may include past and future medical expenses, lost wages and diminished earning capacity, costs of ongoing care and rehabilitation, and damages for pain and suffering. In cases involving conscious disregard of others’ safety, punitive damages may also be available.

In wrongful death cases, Alabama law only allows for the award of punitive damages. Those damages, however, are available if the defendant’s negligence caused another’s death–it is not necessary to show any egregious conduct or conscious disregard of others’ safety to obtain punitive damages in a wrongful death cases. Alabama’s “punitive only” rule for wrongful death damages is unique among the 50 states.

Do I need a lawyer to handle a personal injury claim?

You are not required by law to have an attorney, but the practical consequences of proceeding without one are significant. Insurance companies employ experienced adjusters and defense attorneys whose job is to minimize payouts. An experienced personal injury lawyer understands how to investigate a claim, document damages, negotiate effectively, and take a case to trial when necessary.

What if I was partly at fault for the accident?

Alabama follows a pure contributory negligence rule. If a court finds that your own negligence contributed to the accident, you may be unable to recover compensation. There are a number of exceptions for this rule. For example, contributory negligence is not a defense when the defendant acted wantonly (i.e. acted with conscious disregard of others’ safety) or when the defendant had the “last clear chance” to avoid injury. Alabama’s contributory negligence rules make it especially important to speak with a lawyer before making any statements to insurers or other parties involved in your claim.
