Under the False Claims Act, individuals who successfully expose fraud against the government and subsequently recover losses for the U.S. Treasury may be entitled to a percentage of the total amount recovered. This is known as a qui tam provision. The qui tam provisions of the False Claims Act allow private citizen whistleblowers with knowledge of fraud being practiced upon the government to file a civil lawsuit under seal on behalf of the whistleblower and the United States. The False Claims Act allows for monetary recovery by the government of up to three times the actual damages, plus $5,500 to $11,000 per false claim. For the whistleblower’s assistance in the case, the False Claims Act provides that the whistleblower may receive a reward of between 15 to 30 percent of the recovery.
