On November 3, 2014 the parties announced a proposed global settlement of all U.S. claims in Federal Court in Minnesota. Under the terms of the settlement, any Plaintiff that underwent a qualifying revision surgery will receive a base payment award of $300,000. This base payment award is the largest ever in failed hip litigation. Unlike past implant settlements there are few reductions to the base award. Liberal enhancements are available to those who suffered complications related to the device failure. Additionally, unlike most failed hip settlements, qualified victims are entitled to significant future compensation over the next two years, even if they settle their case now and execute a release.
