The Supreme Court of Alabama has upheld a $1.75 million jury verdict in a 2009 wrongful death suit against Lanier Memorial Hospital in Chambers County, Alabama. The Supreme Court denied the Petition for Rehearing and affirmed the judgment unanimously without opinion after previously affirming the ruling unanimously without opinion in December 16, 2011.

The suit was filed by the family of Cynthia Renee Strong who died in 2004 after receiving treatment at Lanier Memorial. Hare Wynn, on behalf of the plaintiff, argued that the nurse and the hospital should have refused to process the physician’s telephoned discharge order because, “a normal white blood cell count is 5,000 to 10,000, and Ms. Strong’s 50,300 count ‘is an indication that she has a serious infection.'”
