FORMER HEALTHSOUTH CEO RICHARD SCRUSHY FOUND LIABLE FOR FRAUD WHICH NEARLY DESTROYED THE COMPANY
Plaintiffs Awarded A Total of $2.876 Billion
Birmingham, Ala., June 18, 2009 - Today, Jefferson County Circuit Judge Allwin E. Horn III issued a Memorandum Opinion regarding Final Judgment Order against Defendant Richard M. Scrushy in favor of derivative plaintiffs Wade C. Tucker and the Wendell H. Cook, Sr. Testamentary Trust, John P. Cook Trustee.
Judge Horn found Richard M. Scrushy guilty of fraud and awarded the plaintiffs a total of $2.876 billion. The ruling also rescinded Richard Scrushy's employment agreement.
John W. Haley, lead counsel for the plaintiff's firm Hare, Wynn, Newell & Newton said, "The ruling in this historic case is a shot across the bow for those who engage in corporate greed and fraud in our country. In fact, this is much more than a shot across the bow ... it is a full broadside and a tremendous victory for the shareholders of HealthSouth."
The plaintiff's team included lead counsel Haley and Ralph D. Cook, partners in Hare Wynn, Newell and Newton, attorneys Frank P. DiPrima and John Q. Somerville, of Galloway & Somerville. Firms in Delaware, San Francisco and Boston also served on the Tucker team.
