Hare, Wynn, Newell & Newton attorneys achieve $1,850,000 settlement against Ford dealership.
Hare, Wynn attorney Matt Minner along with Jim Pratt successfully concluded a lawsuit on behalf of a 63 year old man who sustained a severe pancreatic injury due to the faulty repair of a Crown Victoria. A customer brought his 1993 Crown Victoria to Allan Vigil Ford for repair of a faulty cruise control. The suit claimed that an inexperienced and untrained apprentice mechanic attempted to make that repair - albeit erroneously. During the post repair test drive, the Alan Vigil Ford employee accelerated to highway speeds and was unable to disengage the cruise control, leading the Crown Victoria to collide with plaintiff's vehicle which was stopped at a traffic signal. Plaintiff's initial post incident medical examinations did not reveal the pancreatic injury but, after a period of time sufficient for necrotization to set in, he was rushed to the emergency department for immediate pancreatic surgery. Plaintiff underwent several additional surgeries and lengthy hospitalizations as a result of recurrent pancreatitis.
Causation in the case was vigorously defended. Numerous depositions, one of which took Mr. Minner to Ghana, Africa, as well as the retention of renowned experts in the field of biomedical engineering, endocrinology and gastroenterology, proved that the pancreatic injury was caused by the collision. The case was settled just before trial.
